Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the StaffHub platform ("Platform") operated by Ryan Norris, trading as StaffHub ("StaffHub", "we", "us", "our"), accessible at https://www.staffhub.co.za. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About StaffHub

StaffHub is a cloud-based workforce management platform designed for any business that employs and manages teams of staff, across all industries. The Platform provides tools for staff management, time and attendance tracking, shift scheduling, timesheet processing, payroll exports, fleet management, incident and occurrence monitoring, uniform and equipment management, inventory and stock management, client portal access, and related services.

2. Eligibility and Registration

2.1 The Platform is available to registered businesses, their employees, and their clients.

2.2 By registering, you warrant that (a) the information you provide is accurate and complete; (b) you have the authority to bind the entity you represent, where applicable.

2.3 Use of the Platform's payment features requires that the user be at least 18 years of age, as mandated by our third-party payment provider, PayFast. StaffHub itself does not impose an age restriction on access to non-payment features of the Platform.

2.4 New registrations are subject to approval. StaffHub reserves the right to decline or revoke registration at its discretion.

3. User Accounts and Security

3.1 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3.2 You must notify StaffHub immediately of any unauthorised access to or use of your account.

3.3 StaffHub may suspend or terminate accounts that are inactive, in breach of these Terms, or pose a security risk.

4. Acceptable Use

You agree not to: (a) use the Platform for any unlawful or fraudulent purpose; (b) upload false, misleading, or inaccurate data; (c) attempt to interfere with the Platform's security or operation; (d) access another user's account without authorisation; (e) scrape, crawl, or harvest data from the Platform; (f) sublicense, resell, or redistribute access to the Platform.

5. Free Trial and Subscriptions

5.1 New company accounts may be granted a free trial period, during which full access to the Platform is provided at no charge. The duration of the trial period is communicated during onboarding.

5.2 During the trial, the Customer's payment method is securely tokenised via PayFast. A once-off card verification fee of R5.00 is charged when the card is registered. This fee is non-refundable and is not credited against any invoice. No subscription fees are billed until the trial period ends.

5.3 Upon expiry of the trial period, the Customer's subscription automatically transitions to a paid subscription. The first invoice covers the period from the trial end date to the end of that calendar month. Subsequent invoices cover full calendar months.

5.4 Subscription fees, billing frequency, and payment terms are as set out in the SaaS Subscription Agreement or as communicated during onboarding.

5.5 Payments are processed via our third-party payment provider, PayFast. StaffHub does not store your card details.

5.6 All prices are in South African Rand (ZAR).

6. Intellectual Property

6.1 All content, software, designs, and trademarks on the Platform are the property of Ryan Norris (trading as StaffHub) or its licensors and are protected by South African and international intellectual property laws.

6.2 You retain ownership of data you upload to the Platform. By uploading content, you grant StaffHub a limited licence to store, process, and display that content solely for the purpose of providing the Platform's services.

7. Privacy

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

8.1 The Platform is provided "as is" and "as available". StaffHub makes no warranties, express or implied, regarding the Platform's reliability, accuracy, or fitness for a particular purpose.

8.2 StaffHub relies on third-party infrastructure (including Google Firebase) and is not liable for outages or disruptions caused by third-party service providers.

8.3 To the fullest extent permitted by South African law, StaffHub's total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

8.4 StaffHub shall not be liable for indirect, consequential, or incidental damages.

9. Termination

9.1 You may terminate your use of the Platform at any time by cancelling your subscription in accordance with the Refund and Cancellation Policy.

9.2 StaffHub may terminate or suspend your access for breach of these Terms, non-payment, or any other reason at its reasonable discretion.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, and the Protection of Personal Information Act 4 of 2013. Disputes shall be subject to the jurisdiction of the courts of the Western Cape.

11. Amendments

StaffHub may update these Terms from time to time. Material changes will be communicated via the Platform or by email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
